Data Protection Policy
To reaffirm its commitment to protecting the personal data of individuals, BRACKS ADVOGADOS has created this Privacy and Data Protection Policy. The policy describes how the personal data of individuals is collected, maintained, used and deleted in our online environments and in our physical units and establishes measures suitable for protecting personal data, good practices and justifications for processing.
1. Whose personal data and sensitive personal data does Bracks Advogados process?
Bracks Advogados processes personal data and sensitive personal data of the following data subjects: partners, clients, employees, interns, job applicants, service providers, partners and third parties, such as, for example, the opposing party in legal proceedings, among others.
2. How is data collected by Bracks Advogados?
Bracks Advogados collects data from the provision of information transmitted by the following people: partners, clients, employees, interns, job applicants, service providers, partners, third parties, internet access, among others.
3. What justifies the processing of this data by Bracks Advogados?
The following legal bases provided for in articles 7 and 11 of the LGPD justify the processing of personal data and sensitive personal data by Bracks Advogados: (i) compliance with a legal or regulatory obligation; (ii) execution of the contract or preliminary procedures related to the contract; (iii) for its legitimate interest; (iv) regular exercise of rights, including in a contract and in judicial, administrative and arbitration proceedings, the latter under the terms of law. 9307.96, arbitration law; and, (v) by consent.
Bracks Advogados processes all personal data and sensitive personal data in accordance with the principles of article 6 of the LGPD, in particular, those of purpose, adequacy and necessity.
4. What types of data are processed by Bracks Advogados?
Bracks Advogados processes the following personal data and sensitive personal data: name, CPF, ID, bank details, addresses, telephone numbers, email address, medical certificates, medical expert reports, curriculum data, medical reports, medical exams, photos, bank account number, names of ascendants, descendants, spouses, among others.
5. Where does Bracks Advogados process this data?
Bracks Advogados processes personal data and sensitive personal data both physically and virtually, keeping files stored in secure locations with restricted access, in accordance with the firm's internal guidelines. All documents are stored on a secure network and follow technical information security standards (ISOs), in addition to being processed in internal systems certified in information security.
This processing also occurs in clients' electronic systems and in public bodies' electronic procedural systems, whether in defense of clients' interests or in protection of the firm's own interests.
6. How does Bracks Advogados limit access and protect this data?
Bracks Advogados is committed to information security, privacy and intimacy. Access to data is limited by internal regulations and all systems comply with information security standards.
Personal data and sensitive personal data are accessed only by authorized persons. The contents of Bracks Advogados folders and systems are accessed using security passwords.
The members of Bracks Advogados follow the rules established in the firm's code of ethics and conduct, among other internal regulations, which include specific internal guidelines for information security and data privacy.
7. How does Bracks Advogados correct, update and delete personal data?
Bracks Advogados has a compliance and LGPD team that can correct, update or delete personal data and sensitive personal data upon justified request from data subjects, by contacting the email: [email protected]
The Compliance and LGPD team will have up to 30 days to respond to the data subject's request.
Bracks Advogados may request reimbursement of expenses for photocopies if it is necessary to print documents.
8. How long does Bracks Advogados process data?
Bracks Advogados maintains personal data and sensitive personal data in accordance with the legislation that deals with the storage period of documents and civil, criminal and labor prescriptions.
